Principle: right to withdrawal, a 14-day cooling-off period
If you buy a product, software or service online, by phone or from a seller at your doorstep (in legal terms a “distance contract” or “off-premises contract”) you have the right to withdraw. This means you can cancel the contract within 14 days without providing any justification (the "cooling-off period").
For products, this means 14 days from the date of delivery.
For services, this means 14 days after the day the contract was agreed.
For software, this means 14 days from the moment of conclusion of the subscription.
If the cooling-off period expires on a non-working day, your deadline is extended until the next working day.
How to request a refund?
You can request a refund from the party (Kubota, Kverneland or your dealer) from whom you have purchased the product or software from (hereinafter referred to as the “Seller”), in your Account page and let us know the reason for return.
The Seller will confirm refund eligibility and the process for returns following the refund request.
Products are eligible for refund unless indicated otherwise (please check whether the product you are looking to purchase is eligible for refund, before commencing the return process).
To qualify for a refund, products must be:
- in new condition and
- in their original packaging, including all accompanying documents (i.e. commercial invoice, packing list, warranty, notices, etc…)
- returned to the Seller. All returns are subject to your Seller’s general terms and conditions.
In addition, please keep all of your receipts.
The Seller cannot be held responsible for any lost returns.
Have you ordered multiple products?
The return period will only begin once you have received all of the products in the same order.
You cannot return the following:
● products that are custom made / personalized / customized
● products that pose potential health protection, hygiene or safety risks
● products with shipping restrictions
● perishable products that expire rapidly, with a short “use by” date
● products you have used
● products or services with fluctuating prices following global markets
● fully delivered services if you expressly agreed to start immediately acknowledging you would lose the right of withdrawal
● sealed audio, video or computer software that you have unsealed
● online digital content that you started downloading or streaming after you expressly agreed to lose your right of withdrawal by starting the performance
● urgent repairs and maintenance contracts
Use of the product before return
Notwithstanding the foregoing, you may only use the product purely and solely to determine the nature, characteristics and functioning. If you use the product more extensively or more often, then this may be subject to depreciation. You are liable for this yourself and you may only receive a partial refund if it has been deemed that the product is not in new condition and has been used extensively before it was returned.
Return fees
If you decide to return the product within the 14-day cooling period, you are responsible for the costs of freight, postage and packaging.
Reimbursement
Without prejudice to any applicable limitation of liability, the basis of compensation shall be limited to the value of the products so returned (excluding insurance, custom fees, taxes, freight and retail value). The value of the products shall be determined by reference to the commercial invoice or the custom declaration. In no circumstance whatsoever, the Seller shall be responsible for indirect damage, loss of profit or consequential damage.
Nevertheless, the following limitations shall apply to reimbursement:
- if you return a product that is damaged from your end, missing parts, not in original condition, or have obvious signs of use for reasons not due to the Seller, or the product or software fails to adhere to conditions described above: up to 50% of the price of the returned product or software might be not reimbursed.
- If you return a software that is opened, activated, used, or missing parts: up to 100% of the price of the returned software might be not reimbursed.
Refunds will be paid back into your original payment card that you have used at the time of the purchase. Payment will be returned to you within 14 days after the product has been received by the Seller.
If you have opted for the option of paying for the products at the point of collection from Kubota or Kverneland third-party place (i.e. dealer), it will advise you on how your funds will be returned to you.
○ You received a damaged or defective product?
Principle: right to withdrawal or replacement for 30 days
In case the product you have purchased is received damaged or defective, you have the right to withdrawal or replacement during 30 days after its reception or collection.
How to request a refund or replacement?
You can request a refund or replacement from the party (Kubota, Kverneland or your dealer) from whom you have purchased the product or software from (hereinafter referred to as the “Seller”), in your Account page and let us know the reason for return.

○ Legal guarantee of the product, what is it?
Principle: right of repair or replacement for 2 years
If the buyer of the product is a consumer (i.e. a natural person), and on top of other options offered by the seller of the product, under EU rules, for 2 years from the delivery of the product, or its collection from Kubota's third-party place (i.e. dealer) if the product you buy turns out to be faulty or does not look or work as advertised, the party having sold the product must repair or replace it at no cost. You always have the right to a minimum 2-year guarantee from the moment you receive the product. However, national rules in your country may give you extra protection.
If a defect becomes apparent within 1 year of delivery, you do not have to prove it existed at the time of delivery. It is assumed that it did unless the party having sold the product can prove otherwise. However, after 12 months, you must demonstrate that the defect is not your fault (the burden of proof is on your side).
Products bought from private individuals are not covered by these rules.
How to request a repair or replacement?
If you are a consumer, you can request a repair or replacement from the party (Kubota, Kverneland or your dealer) from whom you have purchased the product or software from (hereinafter referred to as the “Seller”), in your Account page and let us know the reason for return.
The Seller will confirm repair or replacement eligibility and the process for returns following the repair or replacement request.
Products are eligible for repair or replacement unless indicated otherwise (please check whether the product you are looking to purchase is eligible for repair or replacement, before commencing the return process).
To qualify for a repair or replacement, products must be:

- in their original packaging, including all accompanying documents (i.e. commercial invoice, packing list, warranty, notices, etc…)
- returned to the Seller. All returns are subject to your Seller’s general terms and conditions.

Reimbursement
You are not entitled to reimbursement in case of activation of the legal guarantee. Notwithstanding the foregoing, if the repair or replacement is impossible or the Seller cannot do it within a reasonable time and without significant inconvenience to you, you are entitled to a full or partial refund.
What happens after the legal guarantee?
If the product you buy turns out to be faulty or does not look or work as advertised more than 2 years from its delivery or collection from the Seller, we invite you to consult your product documentation for the warranty terms and conditions. You can contact the relevant contact information as stated in the warranty terms and conditions for help and support with your faulty product.
