Kubota Europe SAS, a company registered under the laws of France, having its registered address at 19 Rue Jules Vercruysse, 95100 Argenteuil, France (hereinafter referred to as “Kubota Europe”) and its sister companies using and making the Website available to their dealers and end-customers (hereinafter collectively, including Kubota Europe, referred to as “Kubota”, “We”, “Our” or “Us”), takes cybersecurity and the protection of your privacy and your personal data seriously. We understand transparency and respect are foundational aspects of longstanding relationships and, therefore, We take every reasonable effort to protect the information you provide to Us.

 

Kubota Europe is a company belonging to Kubota Holdings Europe B.V., a company registered under the laws of The Netherlands, having its registered address at Hoofdweg 1264, 2153 LR, Nieuw-Vennep, The Netherlands (hereinafter referred to as “Kubota Holdings Europe”), itself belong to Kubota Corporation, a company registered under the laws of Japan, having its registered address at 2-47, Shikitsuhigashi 1-chome, Naniwa-ku, Osaka 556-8601, Japan (hereinafter referred to as “Kubota Corporation”).

 

This cybersecurity and fraud prevention policy applies to your use of the Terrako e-commerce website https://terrako.com/, being a marketplace where products, software and services are sold to dealers and end-customers (hereinafter referred to as the “Website”).

 

      GENERAL INFORMATION

 

Please be alert to fraudsters and scammers who may use Kubota, Kubota Holdings Europe and Kubota Corporation identity on websites, including the identity of the Website, email messages or telephone phone calls/ messages to mislead Our customers, dealers, distributors, partners, vendors and/or suppliers to believe that they are in communication with Us. Falling for any of the scams being perpetrated can have a negative financial impact on the victim, so We advise that you are always cautious and take the necessary steps to protect yourself.

 

Kubota, Kubota Holdings Europe and Kubota Corporation is sometimes contacted and informed by individuals who have been involved in a cybercrime which includes Kubota, Kubota Holdings Europe and Kubota Corporation name. For example, individuals who were led to believe that they were purchasing Kubota machines and paid for it in advance based on the promise of collection at Kubota’s offices, however, upon contact with Kubota were told that no purchase had taken place. Unfortunately, at this point the scammers cannot be traced as communications took place outside of Kubota’s official communication channels. Documents that look like they have come from Kubota are used to make it look authentic, however, they are in fact fraudulent documents that are not legitimate. This is one of the many ways that scammers may trick you into making an advance payment. Scammers may also replicate Kubota, Kubota Holdings Europe and Kubota Corporation websites, including but not limited to the Website, domain names and pose as Kubota to attract victims to make them believe they are purchasing an authentic Kubota machine or services. Therefore, please be aware, if you have been contacted by someone who is claiming to be Kubota, one of Our affiliates, parent companies or direct dealers and distributors, and requesting payment in advance (either by bank transfer or with a link to pay, after in the most cases, a contact per mobile), this may in fact be cyber fraud.

 

For this reason and for the protection of you, Kubota, Kubota Holdings Europe and Kubota Corporation implements a range of robust security measures to ensure that your account and personal information are safeguarded against unauthorised access, loss, or theft. These measures include encryption, secure authentication, regular system audits, and proactive monitoring for any potential vulnerabilities. However, despite Kubota, Kubota Holdings Europe and Kubota Corporation best efforts and measures to be put in place, with the everchanging cyber threats and techniques used, there is still a possibility of an incident occurring. Kubota, Kubota Holdings Europe and Kubota Corporation do everything in their power to prevent these scams from happening, but Kubota, Kubota Holdings Europe and Kubota Corporation assume no liability for damages caused through unlawful or fraudulent usage of the Kubota name or unlawful and fraudulent usage of its trademarks and copyright.

 

      CUSTOMERS / USERS RESPONSABILITY

 

To help Kubota to protect your account and personal information, you should take the necessary steps and responsibility for securing your account and following Our recommendations.

You should always avoid:

-        Sharing your account credentials: Never share your username, password, or any other account access information with anyone, even if they claim to be from Kubota, Kubota Holdings Europe and Kubota Corporation or our direct dealers and distributors. We will never ask for this information via email or phone.

-        Engaging in phishing attempts: You must not attempt to impersonate Kubota or any other user by creating fraudulent communications or solicitations that may attempt to gain access to another user's account or sensitive information.

-        Circumventing Our security measures: You may not attempt to bypass or disable any security features implemented to protect your account and data. This includes attempting to hack, brute force, or otherwise exploit the system for unauthorised access.

-        Using public or shared networks to access your account: To minimize the risk of unauthorized access, avoid logging into your account from unsecured or public networks. Always use a trusted and secure network to access your account.

-        Ignoring suspicious activity: If you notice any suspicious or unauthorised activity in your account, do not ignore it. Instead, immediately report it to Our customer support team. Failing to report suspicious activity could put your account and data at risk.

-        Paying without verifying authenticity of the payment documentation if they appear suspicious: If you believe you have been communicating with Kubota or Our direct dealers and distributors and believe you are purchasing from us or Our direct dealers and distributors, you should always check the authenticity of the payment documentation to ensure that you are a not a victim of fraud and scammers impersonating Kubota or its direct dealers and distributors. You can always independently confirm payment details such as bank account details and transfer instructions with Our direct dealers and distributors in person or via telephone call to a trusted and verified phone number through Our official communication channels.

 

      PREVENTING FRAUD AND CYBER THREATS

 

As part of Kubota, Kubota Holdings Europe and Kubota Corporation commitment to cybersecurity, the following tips and recommendations are provided for preventing fraud and securing your account:

-        Do not respond to unsolicited emails or phone calls: Kubota will never ask you to provide sensitive information (like your password or payment details) via email or phone. If you receive such requests, do not respond and report them immediately via the contact us form.

While Kubota, Kubota Holdings Europe and Kubota Corporation take implements reasonable industry standards and security measures to protect the security of your personal data, Kubota, Kubota Holdings Europe and Kubota Corporation are not liable for any loss, damage, or unauthorised access resulting from cyber fraud, including phishing, identity theft, or any other type of fraudulent activity, unless it is directly caused by their failure to comply with applicable security obligations and requirements.

 

      INDEMNIFICATION

 

You agree to indemnify, defend, and hold harmless Kubota, Kubota Holdings Europe and Kubota Corporation, their affiliates, employees, agents, and direct dealers and distributors from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of or related to your failure to comply with the security requirements outlined in these Terms, or if your actions contribute to a cyber fraud incident.

 

      NO GUARANTEE OF FRAUD PREVENTION

 

While Kubota, Kubota Holdings Europe and Kubota Corporation implement industry standard security measures to protect your personal information and mitigate the risks of cyber fraud, Kubota, Kubota Holdings Europe and Kubota Corporation cannot guarantee absolute protection against all forms of cyber crime. You acknowledge and agree that you are using Kubota’s services and products at your own risk and that Kubota, Kubota Holdings Europe and Kubota Corporation shall not be held liable for any damages, losses, or consequences resulting from cyber fraud, except where required by applicable law.
